Definetion & Interpretation

The Terms and Conditions (as may be amended from time to time) is a legal contract and an agreement between you, an individual customer, member, user, or beneficiary of this service of at least 18 years of age ("You"), and F-Pay (together with its subsidiaries and other affiliates, "us", "we", "F-Pay"), regarding Your use of our prepaid mobile/DTH recharge services (known as "Service") to purchase prepaid mobile/DTH recharge (known as "Recharge") and related services on our website "www.F-Pay.in" (known as the "Site"). If you use any of the services provided by us through our app, you shall be exposed to the rules, guidelines, policies, terms, and conditions applicable to specific services, and they shall be deemed to be incorporated into this Terms & Conditions. We reserve the right to change, modify, add or remove portions of these Terms & Condition, at any time without any prior intimation. It is your responsibility to review the Terms & Condition periodically for updates or changes. Your continued use of the website, authenticate that you accept and agree to the updation or changes done by us.

Eligibility

F-Pay app is not eligible to have contract with a minor, unsound or intoxicated person is void, as they are incompetent to contract. If you are a minor i.e. under the age of 18 years, you are only permitted to access our app under the supervision and prior consent of your parent or legal guardian. By accepting the TnCs or by accessing our Services on the F-Pay app, You represent that You are at least 18 years of age and have not been previously suspended or removed by F-Pay, or disqualified for any other reason, from availing the F-Pay Services. In addition, you represent and warrant that you have the right, authority, and capacity to enter into this Agreement and to abide by all the TnCs as part of this Agreement. Finally, you shall not impersonate any person or entity, falsely state or misrepresent your identity, age, or affiliation with any person or entity. Finally, in the event of any violation of the TnCs, F-Pay has the right to suspend or permanently prevent you from availing of service.

Responsibility

F-Pay provides you all the service in a single app so you will be responsible to maintain the confidentiality of your Display Name, Password, contact number, E-mail address, etc. your personal details is important to us-to give you best service, to contact you regarding the service to avail from us. We promise to secure your personal details provided to us. You shall be responsible for all activities that occur under your Display Name and Password. You agree that if You provide any information that is untrue, inaccurate, not current, or incomplete or We have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with these TnCs, We shall have the right to indefinitely suspend or block access of your membership on the website and refuse to provide You with access to the Website. It is your responsibility to ensure that your mobile phone number and your email address are up to date on the app at all times. You agree to notify us promptly if your mobile phone number or e-mail address changes by updating the same on the app through One Time Password verification. If You share or allow others to have access to Your account on the app (“Account”), by creating separate profiles under your Account, or otherwise, they will be able to view and access Your Account information. You shall be solely liable and responsible for all the activities undertaken under Your Account, and any consequences therefrom.

Intellectual property rights

The Website and the processes, and their selection and arrangement, including but not limited to all text, graphics, user interfaces, visual interfaces, sounds and music (if any), artwork and computer code (collectively, the "Content") on the app is owned and controlled by F-Pay or its licensors and the design, structure, selection, coordination, expression, look and feel and arrangement of such Content is protected by copyright, patent and trademark laws, and various other intellectual property rights. Through Your use of the Website, by no means are any rights impliedly or expressly granted to you in respect of such Content. F-Pay reserves the right to change or modify the Content from time to time at its sole discretion. The trademarks, logos, and service marks displayed on the app and website ("Marks") are the property of F-Pay or their vendors/seller or respective third parties. You are not permitted to use the Marks without the prior consent of F-Pay, the seller, or the third party that may own the Marks. Unless otherwise indicated or anything contained to the contrary or any proprietary material owned by a third party and so expressly mentioned, F-Pay owns all intellectual property rights to and into the trademark "F-Pay", and the Website, including, without limitation, any and all rights, title and interest in and to copyright, related rights, patents, utility models, designs, know-how, trade secrets and inventions (patent pending), goodwill, source code, databases, text, content, graphics, icons, and hyperlinks. Except as expressly provided herein, you acknowledge and agree that you shall not copy, republish, post, display, translate, transmit, reproduce or distribute any Content through any medium without obtaining the necessary authorization from F-Pay or third party owner of such Content.

Communication

When you use Services provided by F-Pay send Text messages, Email, Voice call or any other communication mode will be electronically recorded by our end for quality purpose. You consent to receive communications from us electronically, such as e-mails, texts, mobile push notices, or notices and messages on this site or through the other F-Pay, such as our Message Center, and you can retain copies of these communications for your records. If any misconduct or any violation of the TnCs, F-Pay has the right to suspend or permanently prevent you from availing of service in the F-Pay Application.

Disclaimer of Warranties and Limitations of Liabilities

To the full extent permissible law, F-Pay and its third-party partners disclaim all warranties or guarantees – whether statutory, express, or implied – including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement of proprietary rights. No advice or information, whether oral or written, obtained by you from F-Pay or through F-Pay Services will create any warranty or guarantee other than those expressly stated herein. For the purposes of this Disclaimer, You expressly acknowledge that as used in this section, the term “F-Pay” includes F-Pay officers, directors, and employees. You acknowledge that F-Pay user. The F-Pay services and all information, content, materials, products (including software), and other services included on or otherwise made available to you through the F-Pay services are provided by F-Pay on an "as is" and "as available" basis unless otherwise specified in writing. F-Pay makes no representations or warranties of any kind, express or implied, as to the operation of the F-Pay services, or the information, content, materials, products (including software), or other services included on or otherwise made available to you through the F-Pay services unless otherwise specified in writing. You expressly agree that your use of the F-Pay services is at your sole risk. It is your responsibility to evaluate the accuracy, completeness, and usefulness of all opinions, advice, services, merchandise, and other information provided through the site or on the Internet.

Payment

F-Pay may charge users certain fees for accessing our Website and Services as a whole, or certain features of the Website/Services. You agree to pay any such fees, as may be applicable to the Services that you use. All payments made against the purchases/services on application by you shall be compulsorily in Indian Rupees acceptable in the Republic of India. Website will not facilitate transactions with respect to any other form of currency with respect to the purchases made on. F-Pay will try to ensure that you are made aware of the applicability of any fees for a particular use of the Website/Services, as well as the number of fees payable by you for any such use of the Website/Service. You agree that F-Pay may, at any time, charge, modify or waive fees required to use the Website. Your continued use of the Website/Services after such change in the fees will be considered to be your acceptance of such changes, and the applicability of these Terms of Use to such changes.

Before shipping/delivering your order to you, the Seller may request you to provide supporting documents (including but not limited to Govt. issued ID and address proof) to establish the ownership of the payment instrument used by you for your purchase. This is done in the interest of providing a safe online shopping environment to Our Users. And also you agree to provide correct and accurate financial information, such as credit/debit card details to the approved payment gateway or pre-paid payment instrument account details or net banking or UPI account details for availing Services on the app. You shall not use the credit/debit card or pre-paid payment instrument or net banking details or UPI ID which is not lawfully owned by you, i.e. in any transaction, you must use your own credit/debit card or pre-paid instrument account or net banking account or UPI ID. The information provided by you will not be utilized or shared with any third party unless required in relation to fraud verifications or by law, regulation, or court order or in accordance with the terms of the Privacy Policy. You will be solely responsible for the security and confidentiality of your credit/debit card details or pre-paid instrument account or net banking details or UPI ID. F-Pay expressly disclaims all liabilities that may arise as a consequence of any unauthorized use of your credit/ debit card or pre-paid instrument account. You, as a Buyer, shall be entitled to claim a refund of the Transaction Price (as Your sole and exclusive remedy) in case You do not receive the Delivery within the time period agreed in the Transaction or within the time period as provided in the Policies, whichever is earlier. In case you do not raise a refund claim using F-Pay features within the stipulated time then this would make you ineligible for a refund as well as understand that the Payment Facility may not be available in full or in part for certain category of products and/or services and/or Transactions as mentioned in the Policies and hence You may not be entitled to a refund in respect of the Transactions for those products and /or services

Account

You may need your own F-Pay account to use certain F-Pay Services, and you may be required to be logged in to the account and have a valid payment method associated with it. If there is a problem charging your selected payment method, we may charge any other valid payment method associated with your account. You will be responsible for maintaining the confidentiality of your account and password and for restricting access to your account, and you agree to accept responsibility for all activities that occur under your account or password. Immediately notify F-Pay of any unauthorized use of Your Account Information or any other breach of security, and ensure that you exit from Your Account at the end of each session. F-Pay cannot and will not be liable for any loss or damage arising from your failure to comply with this section. You may be held liable for losses incurred by F-Pay or any other user of or visitor to the Website due to the authorized or unauthorized use of Your Account as a result of your failure in keeping Your Account Information secure and confidential.

Arbitration

F-Pay may elect to resolve any dispute, controversy, or claim arising out of or relating to this agreement or service provided in connection with this agreement by binding arbitration in accordance with the provisions of the Indian Arbitration & conciliation act, 1996. Any such dispute, controversy, or claim shall be arbitrated on an individual basis and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in India, and judgment on the arbitration award may be entered in any court having jurisdiction thereof. All administrative fees and expenses of an arbitration will be divided equally between you and us. In all arbitrations, each party will bear the expense of its own lawyers and preparation. The language of the arbitration shall be English or Hindi.

Cancellation & Refund Policies

Recharges and Bill Payment Refund Policies

All Sales of Prepaid and DTH Recharge are final and there will be no refund or exchange permitted. Please be advised that You are responsible for the mobile number or DTH account number you purchase Recharge for and all charges that result from those purchases. F-Pay is not responsible for any purchase of Recharge for an incorrect mobile number or DTH account number.

However, in a case where a transaction has been completed by you on the Site/App, and money has been charged to your card or bank account but a Recharge has not delivered within 24 hours of your completion of the transaction then you may inform us by sending us an email on support@F-Pay.in or Raise a Ticket on the Support page. In such a scenario you will be entitled to a full refund. We request you to include in the email the following details - The Mobile number or DTH account number, Consumer Number, Operator Name, Transaction Value, Transaction Date, and Order Number, F-Pay shall investigate the incident and if it is found that money indeed charged to your card or bank account without delivery of Recharge/BBPS transactions then you will be refunded the money within 5 to 7 working days from the date of the receipt of your email.

For cases, if you are doing Recharge / Bill Payment from your F-Pay the account balance and you have received a success confirmation but not received a Recharge / Bill Payment or any other case you are welcome to log a complaint by opening a support ticket on Support Page or mail us on support@F-Pay.in we will provide you quick resolution.

Money Transfer Refund Policy:

In Money Transfer Transactions the Service is 99% up time and real time status updated from banking partners. In some transaction goes to pending from beneficiary bank end due to wrong beneficiary account or bank server down, then it will be auto-credited to your F-Pay wallet in T+2 working days.

Gift Card Refund Policy:

All Sales of Gift Card are final and there will be no refund or exchange permitted. PleasIn Money Transfer Transactions the Service is 99% up time and real time status updated from banking partners. In some transaction goes to pending from beneficiary bank end due to wrong beneficiary account or bank server down, then it will be auto-credited to your F-Pay wallet in T+2 working days.

In some cases where a transaction has been completed by you on the Site/App, and money has been charged to your card or bank account but a Gift Card has not delivered within 8 hours of your completion of the transaction then you may inform us by sending us an email support or Raise a Ticket on the Support page. In such a scenario you will be entitled to a full refund. We request you to include in the email the following details - Gift Card Operator, Amount, Date of the Purchase, F-Pay shall investigate the incident and if it is found that money indeed charged to your card or bank account without delivery of Gift Card purchases then you will be refunded the money within 5 to 7 working days from the date of the receipt of your email.

Membership Cancellation Policy:

Membership Package are applicable only in Distributors and Franchise partners. All plan is mentioned in pricing page and its full and final. No Cancellation and Refunds applicable in distributor package. If Franchise Partners want cancel his/her partnership within 3 days then full refund will be initiated to the original source within 5 - 7 working days.

You will be responsible for maintaining the confidentiality of your account and password and for restricting access to your account, and you agree to accept responsibility for all activities that occur under your account or password. Immediately notify F-Pay of any unauthorized use of Your Account Information or any other breach of security, and ensure that you exit from Your Account at the end of each session. F-Pay cannot and will not be liable for any loss or damage arising from your failure to comply with this section. You may be held liable for losses incurred by F-Pay or any other user of or visitor to the Website due to the authorized or unauthorized use of Your Account as a result of your failure in keeping Your Account Information secure and confidential.

In Money Transfer Transactions the Service is 99% up time and real time status updated from banking partners. In some transaction goes to pending from beneficiary bank end due to wrong beneficiary account or bank server down, then it will be auto-credited to your F-Pay wallet in T+2 working days.

Gift Card Refund Policy:

In some cases where a transaction has been completed by you on the Site/App, and money has been charged to your card or bank account but a Gift Card has not delivered within 8 hours of your completion of the transaction then you may inform us by sending us an email support or Raise a Ticket on the Support page. In such a scenario you will be entitled to a full refund. We request you to include in the email the following details - Gift Card Operator, Amount, Date of the Purchase, F-Pay shall investigate the incident and if it is found that money indeed charged to your card or bank account without delivery of Gift Card purchases then you will be refunded the money within 5 to 7 working days from the date of the receipt of your email.

Membership Cancellation Policy:

Membership Package are applicable only in Distributors and Franchise partners. All plan is mentioned in pricing page and its full and final. No Cancellation and Refunds applicable in distributor package. If Franchise Partners want cancel his/her partnership within 3 days then full refund will be initiated to the original source within 5 - 7 working days.
